1. Introduction

Marea Digital Pty Ltd ("Company", "we", "our", or "us") respects your privacy and is committed to protecting it through our compliance with this Privacy Policy. This policy explains how we collect, use, store, and disclose information when you access our websites, download or use our mobile applications (including Valence Arc), or use any associated online services (collectively, the "Services").

In this policy, "Personal Information" has the meaning given in the Privacy Act 1988 (Cth) and includes information or an opinion about an identified individual, or an individual who is reasonably identifiable. Some technical identifiers (such as an advertising ID) may be Personal Information. If you are located outside Australia, additional local privacy laws may also apply to you.

2. Information We Collect and How We Collect It

Our Services are designed to prioritize a frictionless user experience. We generally do not require you to create an account, and for standard gameplay you typically do not need to provide direct identifiers such as your name or email address.

However, to support the functionality, security, analytics, and monetization of our Services, we and our third-party service providers (such as analytics and advertising partners) may collect certain information automatically when you access or use the Services. Under the Australian Privacy Principles (APPs), some of these technical identifiers are classified as Personal Information.

• Device & Identifiers: Device model, operating system, language, time zone, your device's advertising identifier (e.g., Apple IDFA or Google AAID), app instance identifiers, and IP address.
• Usage & Performance Data: Gameplay metrics (such as session length and in-game events), interaction data, diagnostic information, and crash reports.
• Approximate Location: We (or our partners) may infer an approximate location from your IP address for purposes such as analytics, fraud prevention, and ad delivery.
• Purchases: If you make an in-app purchase, the app stores process the payment. We may receive purchase confirmation and transaction-related information (for example, the product purchased and the time of purchase), but we do not receive your full payment card details.
• Support Communications (if you contact us): If you email us or contact support, we will receive the information you include in your message (such as your email address and the content of your request).

3. Third-Party Data Collection and Cross-Border Transfers

Our Services may integrate third-party Software Development Kits (SDKs) and APIs, including advertising networks (for example, Google AdMob and Unity Ads) and analytics/diagnostics providers. These third parties may collect information directly from your device to provide their services to us (such as ad delivery, measurement, and app analytics).

• Advertising & Analytics: These third parties may use identifiers and similar technologies to collect technical data in order to (a) serve personalized or non-personalized advertisements (depending on your settings and region), and (b) provide us with aggregated usage and performance statistics. Their collection and use of information is governed by their own privacy policies.
• Cross-Border Disclosure (APP 8): Some of our service providers and their servers are located outside Australia (often including the United States). As a result, Personal Information may be disclosed to, stored in, or processed in those locations. Where required, we take reasonable steps to ensure overseas recipients handle Personal Information in a manner consistent with the Australian Privacy Principles. We rely on one or more permitted bases under the Privacy Act 1988 (Cth) for such transfers, which may include your consent, contractual necessity, or another applicable ground.

4. How We Use Your Information

We use the information that we collect automatically or that our third-party providers collect to:

• Provide, maintain, and improve our Services.
• Serve advertisements that allow us to offer certain Services for free.
• Monitor aggregate metrics such as total number of users, engagement, and app performance trends.
• Diagnose and fix technology problems.

5. Data Security

We use reasonable administrative, technical, and physical safeguards designed to protect Personal Information from misuse, interference and loss, and from unauthorized access, modification, or disclosure. However, no method of transmission over the internet or method of electronic storage is completely secure.

6. Data Retention and Service Discontinuation

We retain your technical data only for as long as is reasonably necessary to fulfill the purposes outlined in this Privacy Policy, or as required by law. In the event that Marea Digital Pty Ltd formally discontinues a specific Service or terminates its operations entirely, we will securely destroy or de-identify any stored personal information within a reasonable timeframe, in accordance with our data lifecycle protocols.

7. Disclosure of Your Information

We do not sell your personal data. We may disclose aggregated, non-personally identifiable information without restriction. We may disclose the technical data collected:

• To contractors and service providers we use to support our business (e.g., ad networks, hosting providers).
• To a buyer or successor in the event of a merger, restructuring, or sale of Marea Digital Pty Ltd's assets.
• To comply with any court order, law, or legal process.

8. Your Choices, "Do Not Track", and Opt-Out Rights

• Do Not Track: Our mobile applications rely on operating system-level privacy controls. Our websites do not currently respond to browser "Do Not Track" (DNT) signals.
• iOS Users: You can manage interest-based advertising and tracking permissions in your device settings (for example, Settings > Privacy > Tracking, and Settings > Privacy > Apple Advertising).
• Android Users: You can manage your advertising ID and ad personalization in your device settings (for example, Settings > Google > Ads, including options such as deleting your advertising ID and opting out of ad personalization).

9. Access and Correction Rights (APP 12 & 13)

Under the Australian Privacy Principles, Australian users have the right to request access to the Personal Information we hold about them and to request corrections if that information is inaccurate, out-of-date, or incomplete. To exercise these rights, or to request deletion of your information (where applicable), please contact us using the details provided in Section 13.

10. Children's Privacy

Our Services are not directed to children under 13 years of age. We do not knowingly collect Personal Information from children under 13. If you believe a child under 13 has provided Personal Information to us, please contact us and we will take reasonable steps to delete that information and, where required, respond in accordance with applicable law.

11. Changes to Our Privacy Policy

We may update our Privacy Policy from time to time. If we make material changes to how we treat our users' information, we will notify you via an in-Service notification, website update, or an update to the relevant App Store listing. Continued use of the Services following such notice constitutes your acceptance of the updated policy.

12. Complaints

If you have a complaint about how we handle Personal Information, please contact us and we will respond within a reasonable time. If you are not satisfied with our response, you may be able to lodge a complaint with the Office of the Australian Information Commissioner (OAIC) (www.oaic.gov.au).
